Soulsky 's Privacy Policy

Welcome to Soulsky ("Platform" or "APP"). The Platform is provided and controlled by Soulsky (" Soulsky ", "we" or "us"). These Terms of Service ("Terms") are written in English (US). These Terms are a legal agreement between you and Soulsky . If any translated version of the Terms Agreement conflicts with the English version, the English version shall prevail.

We know that the use of your personal data by others is a major concern for social network users, so Soulsky has developed this Policy to let you know how we use personal information ("Personal Data" or "Personal Information"). We recommend that you read this Policy in conjunction with our Terms and Conditions of Use ("Terms"). When you visit or use Soulsky , you agree to our Privacy Policy and consent to our collection, storage, use and disclosure of your personal information in accordance with this Policy. Soulsky reserves the right to change this Policy at any time without prior notice, so be sure to review this Policy regularly to understand how we use your information. By installing, using, registering or otherwise accessing the Service, you agree to this Privacy Policy and expressly and knowingly consent to our processing of your personal data in accordance with this Privacy Policy. If you do not accept and agree to our Privacy Policy, you must not access or use the Application.

A. Information You Provide to Soulsky

a. Account Data: In order to use certain features (register an account), you need to create a user account. When you create or update an account, we collect and store the data you provide, such as your email address, name, gender, and date of birth, and assign you a unique identification number ("Account Data").

b. Profile Data: You may also choose to provide profile information, such as photos, information, name, or other data. Unless you delete your account, your profile data will be publicly available for others to view. To add certain content (such as pictures or videos), you may allow us to access your camera, microphone, or photo album. Some of the information you choose to provide to us may be considered "special" or "sensitive" in some jurisdictions. By choosing to provide this information, you consent to our processing of this information.

c. Usage Data: When you use our services and features, we collect certain data, including messages, follow-up information, photos, videos, and other user data. Of course, as part of the operation of the service, we also process your chats with other users and the content you post.

d. Shared Content: Some services allow you to interact with other users or share content publicly, including videos you post and data you provide in your profile. Such shared content may be publicly viewable by others, depending on where it is posted.

e. Promotions: When you choose to participate in our promotions, events, or contests, we collect the information you used to register or participate. If you win a prize, we collect financial information to reward you.

f. Data about your accounts on other services: If your social media or other online accounts are connected to your accounts on our services, we may obtain certain information through them. If you log in to our services through Google or other third-party platforms, we will ask you for permission to access certain information about that other account. For example, depending on the platform or service, we may collect your name, profile picture, gender, information, and birthday.

These platforms and services provide us with information through their APIs. The information we receive depends on what information you (through your privacy settings) or the platform or service decides to provide to us.

If you access or use our services through a third-party platform or service, or click on any third-party links, the collection, use, and sharing of your data will also be subject to the privacy policy and other agreements of that third party.

g. Data about paid services: All of our paid services are provided through iOS or Android platforms. We only receive transaction receipts provided by these platforms. For security reasons, we do not collect or store sensitive cardholder data, such as full credit card numbers or credit card authentication data.

h. Communications and Support: If you contact us for support or to report a problem or concern (regardless of whether you have created an account), we will collect and store your contact information, messages, and other data about you, such as your name, email address, location, operating system, IP address, and any other data you provide or we collect by automated means (as we describe below). We will use this data in accordance with this Privacy Policy to respond to you and research your question or concern. If you ask us to communicate with another person or otherwise process their information (for example, if you ask us to send an email to one of your friends on your behalf), we will collect the information you provide to us about that other person in order to fulfill your request.

i. Sensitive Information: Please be careful about posting sensitive information about yourself in your profile, such as your sexual orientation, religious affiliation, and health information. While you can voluntarily provide us with this information, including your sexual orientation and ethnic background, when you create your profile, it is not mandatory. Keep in mind that photos or any video footage you post on our services may reveal these types of sensitive personal data. If you upload and choose to tell us sensitive data about yourself, you explicitly consent to us processing your information and making it public to other users.

B. Personal information automatically collected when you use our applications

When you use Soulsky , we will collect certain information from your device, including device model, device ID (Android ID, IMEI, IMSI, Mac address), software list, device operation status information, operating system version, network log, Internet connection status, software usage record and IP address. We collect this information for error analysis and anti-spam measures to ensure that you can use Soulsky normally and protect the security of your account. The above information is the basic information we need to provide you with services. If you refuse to provide such device information, we may not be able to provide you with normal services. We may also use the above information that we automatically collect from your device to improve and optimize our product experience. In such cases, we only process your device information based on your authorization and/or other available legal basis stipulated by applicable data protection laws.

C. Information We Receive from Others

In addition to information you may provide to us directly, we also receive information about you from other people, including: Social Media You may decide to share information with us through your social media account, for example, if you decide to create and log in to your Soulsky account through your social media or other account (such as Google).

2. How we use your information

In addition to some of the specific uses of information described in this Privacy Policy, we may use the information we receive for the following purposes:

a. Help you access your information efficiently after logging in;

b. remember information so that you do not have to re-enter it during your visit or the next time you visit the Services;

c. provide personalized content and information to you and others, which may include online advertising or other forms of marketing;

d. provide, improve, test and monitor the effectiveness of our services;

e. Develop and test new products and features;

f. Monitor metrics such as total visitor numbers, traffic volume, and demographic patterns;

g. diagnose or repair technical problems;

h. Automatically update the APP on your device Soulsky or other users may hold competitions, special offers or other activities ("Activities") on the Services. If you do not want to participate in an Activity, please do not use specific metadata (ie, tags) associated with that Activity.

Soulsky open access areas are used as advertising and promotional materials for our partner websites and partner products. We believe these uses allow us to improve our website and better tailor your online experience to meet your needs.

3. How we share your information

a. We do not sell or rent any of your personal information to any third party. We may disclose aggregated, non-personal information for marketing and promotional purposes. This means that we do not disclose any information that can be used to identify you.

Soulsky also wants to maintain a healthy community, and we will cooperate with all third parties to enforce their intellectual property or other rights.

c. We will also cooperate with law enforcement investigations within and outside your country. This may include disclosing your personal information to government or law enforcement agencies or private parties to protect the rights, property or safety of Soulsky and APP users, or to protect the public interest when we believe in good faith that the law requires disclosure or when we believe in our sole discretion that disclosure is necessary to protect our or a third party’s legal rights and/or comply with a judicial proceeding, court order or legal process served on us. In this case, we may raise or waive any legal objections or rights we may have.

d. We may also share your information with other members of our corporate group, subsidiaries or affiliates to improve, optimize Soulsky and prevent unlawful use.

f. Third-party SDK providers: Soulsky may integrate third-party SDKs or similar applications. However, we strive to assess the access qualifications of these third parties and require compliance with legal, security and privacy standards. We try our best to provide security measures for users' personal information to prevent illegal use, unauthorized access, disclosure, leakage, damage and loss of users' personal information. We will use all possible security measures within a reasonable security level to ensure information security. For example, we will use encryption technology (such as SSL), anonymization, encrypted storage and other means to protect your personal information; we will establish a reliable protection mechanism to prevent personal information from malicious attacks; we will establish an access control mechanism and abide by the principle of minimum access to ensure that only authorized personnel can access personal information; we will conduct training courses on security and personal information protection to enhance employees' understanding of personal information protection.

If you find that your personal information, especially your account or password, has been leaked, please contact us immediately so that we can take appropriate measures based on your request. 4. Data Storage and Retention

A. Storage: Soulsky is a global social application, and if you reside in a country with data protection laws, the storage of your personal data may not provide you with the same protection as in your country of residence. By submitting your personal information, or choosing to upgrade the services you use, or using the applications available on Soulsky , you consent to the transfer of your personal information to any such countries and destinations and the storage and processing of your personal information in those countries.

B. Retention: We generally retain your personal data for as long as you keep your account open or as needed to provide you services. This includes data you or others provide to us and data generated or inferred from your use of our services. In some cases, we choose to retain certain information in a depersonalized or aggregated form (for example, insights about service usage).

5. Security

Soulsky has implemented reasonable and appropriate security measures to protect and prevent the loss, misuse and alteration of the information under our control, including your personal information. Soulsky uses reasonable security measures to protect the confidentiality of your personal information, such as using firewalls to protect servers. Soulsky's technical experts work hard to ensure that you are safe when using our website. Although we take reasonable precautions to prevent possible security breaches of our website, member databases and records, no website or Internet transmission is completely secure and we cannot guarantee that authorized access, hacking, data loss or other breaches will never occur. We urge you to take steps to keep your personal information secure (including your password) and to log out of your account after use. We cannot guarantee the security of your personal data while it is transmitted to our website. Any transmission is at your own risk. Once we have received your information, we have procedures and security features in place to try to prevent authorized access.

6. Deleting your account

You may request deletion of your account at any time. Before you submit a request to delete your account (a "Deletion Request"), please ensure that your account meets the following requirements:

a. Account in good standing: Your account (including other related services, such as your Soulsky wallet account) is in good standing and is not the subject of any ongoing investigation, penalty, or allegation for violation of our Terms of Use and/or applicable laws and regulations;

b. No Open Transactions: There should not be any pending orders, payment obligations, refunds, deliveries, returns and/or disputes in your account. Your most recent order must have been completed and delivered at least seven (7) calendar days prior to the date of this removal request;

Soulsky account should not have any virtual item balance (including diamonds, coins ). Please make sure that you have used up all virtual item balance in your account, or you can choose to give up the remaining balance to continue the account deletion process;

Any other standards that Soulsky may notify you from time to time.

Deleting your account

Open the Soulsky app and log in, tap Me > Settings > Delete Account > Confirm to delete your account.

Provided that the above deletion conditions are met and/or waived, the account will be deleted immediately upon your request.

If you delete your account:

a. You cannot regain access to your account.

b. Certain information, such as messages, comments, opinions and other content or information you submit to the Platform, will not be stored in your account. This means that even if your account is deleted, other users may continue to have access to the messages you send and the comments, opinions or other content you post on the Platform.

Even if you delete your account, we may still retain certain log data in our databases, but this data will be separated from any identifying information so that it can no longer be associated with your account. To do this, we periodically remove certain identifying information from this log data and replace any instances of your account ID with a replacement identifier that, once deleted, can no longer be associated with your account.

We may also retain your information for legal issues, violations of our terms, or to prevent harm.

Please further note that the deletion of your account is irreversible. You understand that once you delete your account, we will no longer be able to provide you with Soulsky services and will not be able to collect your personal information. Therefore, we recommend that you exercise caution when choosing to delete your account.

7. Your rights

Soulsky user specific rights, which are listed in this section. Under applicable law, you may have all or some of the following rights. We will respond to your request as soon as possible (usually within one month) in accordance with applicable law after going through appropriate verification procedures. You are generally free of charge to exercise these rights, unless we believe that a fee is required under applicable law.

Although we cannot guarantee the complete erasure of your data stored in our backup servers, we promise not to use the data in the backup servers for any other purpose.

d. Right to data portability: If the information is collected based on your consent, you can ask us to transfer some of your personal information to you or another environment specified by you (if technically feasible) in a structured, commonly used and machine-readable format by (a) using the " Feedback " function on the Soulsky Service , or (b) sending us an email request at liujuxiang3742@outlook.com

e. Right to withdraw consent: If the information is collected based on your consent, you can withdraw your consent and ask us to stop collecting or processing your personal information at any time by (a) using the " Feedback " function on the Soulsky Service or (b) sending us a request via email. Your exercise of this right will not affect the processing activities that occurred before your withdrawal.

f. Right to restrict processing: If you believe that such information was collected unlawfully or you have other grounds, you may request that we stop processing your personal information by (a) using the help or feedback features on the Soulsky Service or (b) sending us an email at liujuxiang3742@outlook.com . g. Right to object: You may object to the processing of any personal information about you at any time, if such information is collected based on legitimate interests, by (a) using the " Feedback " feature on the Soulsky Service, or (b) sending us your request by email at liujuxiang3742@outlook.com . Please note that we may deny your request if we demonstrate compelling legitimate grounds for the processing which override your interests and freedoms, or if the processing is for the establishment, exercise or defense of legal claims.

h. Rights regarding automated decision-making and analysis: If you believe that such automated decision-making and analysis has a legal or similar significant impact on you, you can ask us to stop automated decision-making or analysis by (a) using the help or feedback function on the Soulsky service or (b) sending your request by email to liujuxiang3742@outlook.com . We will review your request and let you know whether your request is subject to relevant laws and regulations.

In addition to the rights set out above, you also have the right to lodge a complaint with the competent data protection authority (“DPA”), typically the DPA in your country.

Soulsky asks for system permissions

As mentioned above, in order to provide you with Soulsky products and/or services, we may need to use the system permissions in your device (excluding permissions called by third parties) to collect relevant personal information. Although we have already touched upon this in the previous section, this section will summarize all system permissions used by the Soul sky App to facilitate a more systematic, complete and transparent presentation to you. You can choose whether to authorize us to use the relevant permissions of your device. If you do not authorize us to use the relevant permissions, some services may be unavailable, but it will not affect your use of other functions of the Soul sky App.

a. Notification: After you grant us push notification permission, we will send you push notifications so that you can receive and understand our notifications in a timely manner. If you refuse to allow such access rights, you will not be able to receive our notifications.

b. Access to photo albums and storage: After you grant us this access permission, we will access your photo albums and use the storage function on your device. It will be used for you to upload text, pictures, videos and other content in your device, and cache the text, pictures and video content generated during your use of Soulsky services. Please note that we will not access your local storage content. If you refuse to grant us such access permission, you will not be able to use the features that require this access permission.

c. Microphone access: Once you grant us this access permission, we will use the microphone on your device and recognize the voice information you transmit. This access permission will be used to perform voice input and voice changing functions, and collect and recognize voice information input when these functions are triggered. If you refuse to allow this access permission, you will not be able to use the functions that require this access permission.

d . Camera permissions

Once you agree to enable this permission, we will use the camera function on your device. This function will be used to take photos and record videos, and collect and identify the pictures and videos taken or recorded during the implementation of the above functions. If you refuse this authorization, the above functions will not be available.

e . Appear on top permission

minimized content of the " Voice Chat Room " float on other content, we will apply for your " Appear on top" permission. If you refuse such authorization, the above function will not be available.

f . Device information access rights

After you agree to enable this permission, in order to protect your account and login security, we will collect your corresponding device information for optimizing user experience, security checks, identifying whether it is a commonly used device, and device binding status. If you are an Android user, your refusal to grant this authorization will result in your inability to use this product and/or service normally. If you are an iOS user, you may not be able to directly refuse or close the above authorization due to the limitations of the iOS system, but for some device information (for example, IDFA information, which is subject to the actual situation updated from time to time by the iOS system policy), you can choose whether to authorize us to collect it. If you refuse to authorize, we may not be able to provide you with the corresponding functions or services (for example, if you refuse us to collect your IDFA information, we will not be able to provide you with personalized display based on the IDFA tracking identifier).

g . Access the network and obtain network status permissions

Our APP can only connect to the Internet after you agree to enable this permission. At the same time, for the purpose of risk control and service provision, we can also monitor network changes and remind users of the current network environment. If you refuse this authorization, you will not be able to use this product and/or service normally.

9. Children’s Privacy

Soulsky does not intentionally collect or solicit personal information from children under the age of 18 , nor does it intentionally allow such persons to register. If you are a child as defined by applicable law, please do not attempt to send us any information about yourself, including your name, address, telephone number or email address, without the permission of your parents or legal representatives.

Soulsky provides any personal information. Taking into account the current technology, we will make commercially reasonable efforts to verify that the above consent is given by the child's representative. When we learn that we have collected personal information of a child without parental consent, we will delete that information as soon as possible. Children's personal data may be collected without the above consent when the collection is necessary to contact parents or legal representatives, one-time use and not storage, or for their protection, and in any case, the data shall not be passed to third parties without the consent provided herein. All materials in the APP are owned by Soulsky and protected by copyright laws around the world. Unless you obtain the express written permission of Soulsky, you are only authorized to use Soulsky and its content for personal, non-commercial use.

B. Disclaimer

Soulsky provides all materials on an "as is" basis and hereby disclaims all representations or warranties of any kind, express or implied, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, non-infringement or other infringement arising out of the use, accuracy or reliability of the materials on the Service or any linked website. You acknowledge that any transmission may be intercepted. Soulsky does not warrant that its services or the servers that make the services available or the electronic communications transmitted are free of viruses, worms, horses and other destructive features.

C. Links to Third-Party Websites

There may be links directing you to third-party websites, which are provided for your convenience only. Soulsky does not endorse or make any representations or warranties regarding the content, products, available services or security of such third-party websites .

Soulsky at the time of its presentation may contain certain forward-looking statements, plans and objectives relating to the financial condition, operations and business of Soulsky and/or any of its affiliates. Forward-looking statements are only predictions and are not guarantees of future performance. E. Limitation of Liability

Soulsky shall not be liable for any damages arising out of or related to the use or inability to use the App, its content or links, including but not limited to damages caused by or related to errors, omissions, interruptions, defects, delays in operation or transmission, viruses, application failures, and all other direct, indirect, special, incidental, exemplary or consequential damages, even if Soulsky has been advised of the possibility of such damages. Soulsky's total liability to you for all losses, damages and actions (including but not limited to losses, damages and actions based on contract, tort or otherwise) arising out of your use of the App, its content or links shall not exceed $200.

F. Prohibited Use

Soulsky does not permit purposes. You may not use our Service or its content in any manner that could damage, disable, overburden, or interfere with anyone else's use of the Service. You may not attempt to gain unauthorized access to other accounts, computer systems, or network connections to the Service through hacking, password mining, or any other means. You may not use or attempt to use the Service through any means not intended or intentionally made available by Soulsky .

G. Intellectual Property Protection

Soulsky respects intellectual property laws and adopts the following policy regarding intellectual property infringements of its products/services. Reporting instances of intellectual property infringement If you believe that any material or content in the Soulsky APP infringes a copyright, trademark, patent or trade secret (collectively, "Intellectual Property"), please send an intellectual property infringement notification to Soulsky's agent and include a handwritten signature of the owner of the intellectual property that is allegedly infringed.

a. Identify the material that is claimed to be infringing, including where it is located on the Soulsky network, and provide sufficient detail to allow Soulsky to locate the material and verify its existence. Please state your intent to have the allegedly infringing material removed.

b. Contact information, including your name, address, telephone number, and email address.

c. A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law.

d. A statement by you that the above information in your notice is accurate and, under penalty of perjury, that you are the intellectual property owner or are authorized to act on the intellectual property owner's behalf.

1. Changes to this Privacy Policy

We may change this Privacy Policy periodically to keep up with new technologies, industry practices and regulatory requirements, among other reasons.
